Welcome to SleepTailor! The terms “we”, “us” and “our” refer to SleepTailor. SleepTailor operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). SleepTailor is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. By proceeding with a purchase or continuing to use our Services, you also acknowledge that you have read, understood, and expressly consent and agree to all policies outlined within these Terms of Service, including but not limited to our Warranty Policy, Return & Exchange Policy, and Shipping & Delivery Policy. If you don't agree to these Terms of Service or Privacy Policy, you shouldn't use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you're at least the age of majority in your state or province of residence, and you've given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase, or manage.
To use the Services, including accessing or Browse our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current, and complete and that you have all rights necessary to provide this information.
You're solely responsible for maintaining the security of your account credentials and for all of your account activity. You can't transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We've made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We don't warrant that the appearance or quality of any products or services you purchase will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region, or jurisdiction, on a case-by-case basis.
SECTION 3 - ORDERS
When you place an order, you're making an offer to purchase. SleepTailor reserves the right to accept or decline your order for any reason at its discretion. Your order isn't accepted until SleepTailor confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as SleepTailor may be unable to accommodate cancellation requests after an order is accepted. If we don't accept, make a change to, or cancel an order, we'll try to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Return & Exchange Policy (Section 7).
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 - PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices don't include taxes, shipping, handling, customs, or import charges.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there's a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
SECTION 5 - SHIPPING AND DELIVERY
At SleepTailor, we're committed to providing you with a seamless and luxurious experience, right from crafting your bespoke mattress to its delivery at your doorstep. Our shipping and delivery services are designed for your convenience, ensuring your new mattress arrives safely and is set up perfectly.
1. Initial Order Delivery (Delhi NCR) We're pleased to offer complimentary shipping and delivery for all new mattress orders within the following regions:
- Delhi NCR (including Delhi)
- Noida
- Greater Noida
- Gurugram
- Faridabad
- Ghaziabad
- And all major cities in the vicinity of Delhi.
Our Premium Delivery Service Includes:
- Free Same-Day Delivery: For orders confirmed by 2 PM on business days, we strive for same-day delivery and installation within Delhi NCR, subject to availability and unforeseen circumstances. Our team will contact you to confirm the earliest possible delivery slot.
- White Glove Delivery & Installation: Our professional delivery team will not only deliver your mattress but will also carry it to your room of choice, unbox it, and set it up on your bed frame.
- Free Old Mattress Removal: As part of our commitment to convenience, we'll also remove your old mattress at no additional charge. Please ensure your old mattress is ready for removal upon our arrival.
What to Expect on Delivery Day:
- Our delivery team will contact you on the day of delivery to confirm their estimated arrival time.
- Please ensure clear access to your bedroom for a smooth delivery and installation process.
- Once installed, our team will ensure everything is to your satisfaction before they depart.
Risk of Loss and Delays: All delivery times are estimates only and aren't guaranteed, especially in cases of unforeseen circumstances such as traffic, weather, or other events outside our direct control. We're not responsible for delays caused by such events. While SleepTailor manages the delivery process directly for initial orders within Delhi NCR, title and risk of loss for products pass to you upon successful delivery and installation at your specified address.
2. Shipping for Warranty Claims Our commitment to your satisfaction extends to our warranty service. Shipping costs related to warranty claims are handled as follows:
- First Valid Warranty Claim: For the first valid warranty claim on your SleepTailor mattress (where a manufacturing defect or covered issue requires repair as per our warranty terms), SleepTailor will bear the full cost of picking up your mattress for repair and delivering it back to you once the repair is complete. This service is provided at no charge to the customer for the first instance.
- Subsequent Valid Warranty Claims: Should your mattress qualify for a second valid warranty claim (applicable only for mattresses with a 10-year or more warranty period), a nominal shipping charge will be applicable and borne by the customer for the pick-up and re-delivery of the mattress for repair. Our team will inform you of the exact charges beforehand.
How to Arrange Warranty Shipping:
- All warranty claims, including arrangements for pick-up and re-delivery, must be initiated through our official  WARRANTY CLAIM PAGE. Our team will guide you through the process and schedule the logistics once your claim is approved.
SECTION 6 - WARRANTY POLICY
At SleepTailor, we're committed to providing you with the highest quality craftsmanship and exceptional comfort. Our mattresses come with a comprehensive warranty that covers any manufacturing defects or faults under normal usage.
1. Warranty Coverage: Our warranty covers manufacturing defects and faults under normal usage, including:
- A. Defects in materials or workmanship
- B. Sagging or indentations greater than 3 inches (under normal usage).
- C. Any other manufacturing defects that arise during the warranty period.
2. Warranty Period: Your SleepTailor mattress comes with up to 12 years of warranty from the date of purchase. This warranty period covers manufacturing defects and issues arising under normal use, ensuring that you can sleep soundly for years to come. The warranty period begins from the date of purchase, as indicated on your receipt. Your mattress must be used on a proper foundation or bed frame for the warranty to remain valid.
3. What’s Not Covered: While we take great care in ensuring the highest quality of our mattresses, some factors are beyond the scope of our warranty. Please note that the following aren't covered:
- A. Normal wear and tear over time (e.g., minor fabric wear, slight indentations due to regular use etc.).
- B. Damage caused by improper care (e.g., stains, burns, spills, uneven surface etc.).
- C. Misuse of the mattress (e.g., using the mattress for purposes other than sleeping, or placing it on an improper bed frame or foundation).
- D. Changes in firmness or comfort preference.
- E. Damage resulting from an accident or external forces (e.g., damage caused by pets, extreme weather conditions).
- F. Mattresses with tags removed.
- G. Damage caused because of not following care and instructions manual.
- H. Damage caused because of heat exposure to the mattress. Avoid exposing mattress to sunlight, heating appliances, ironing press, or other heating appliances.
This warranty is intended to cover any inherent manufacturing defects, not damage resulting from misuse or lack of proper care.
4. Exclusions & Limitations: While we aim to offer comprehensive coverage, there are certain limitations and exclusions to our warranty:
- Transferability: This warranty is valid only for the original purchaser and isn't transferable.
- Improper Use: Damage caused by the improper use of the mattress, including but not limited to excessive weight or incorrect foundation use, isn't covered.
- Personal Preference: The warranty doesn't cover dissatisfaction with the mattress firmness or comfort level, as these are subjective preferences.
- Third-Party Products: Any damage resulting from the use of third-party products, such as mattress protectors or sheets, that may affect the mattress is excluded from the warranty.
- Commercial Use: This warranty doesn't cover mattresses used in commercial settings, including hotels, guesthouses, or rental properties.
Please read and understand these exclusions carefully to ensure that your mattress remains eligible for warranty coverage.
5. Warranty Means Repair Only: The warranty provided by SleepTailor includes repair services only. In no case will we be liable for full replacement of the mattress. Our warranty covers the repair of defects by opening the mattress and replacing materials that can't be repaired. The decision to repair or replace materials will be made based on expert evaluation.
6. Number of Claims:
- Mattresses with an 8-year or less warranty period: Limited to 1 claim per mattress.
- Mattresses with a 10-year or more warranty period: Limited to 2 claims per mattress.
Please note that each mattress is eligible for the number of claims based on the warranty period.
7. Proof of Purchase: No warranty claim will be accepted without the presentation of the original bill that includes the signature of the purchaser. Only the original physical bill with the purchaser’s signature is valid as proof of purchase. Without this, SleepTailor won't be liable for any claims or repairs.
8. No Monetary Compensation or Full Replacement: Our warranty doesn't include monetary compensation or the full replacement of the mattress. If there's a valid warranty claim, SleepTailor is only liable for 50% of the mattress value as the maximum compensation.
9. Claim Submission Process: All claims must be submitted via our official website. To ensure a seamless process, please provide all necessary details as requested during the claim submission. Incomplete claims or missing information may delay processing.

How to Make a Claim:
- Visit Our Website: Start by visiting our official website. Navigate to the WARRANTY CLAIM PAGE, where you can find the claim form.
- Fill Out the Claim Form: Complete the form with accurate details about your mattress and the issue.
- Submit the Claim: Once you’ve filled out the form and attached all required information, submit your claim. Make sure all the details are accurate and complete to avoid delays in processing.
- Assessment by Our Experts: After your claim is submitted, our expert team at SleepTailor will evaluate the issue and assess whether it qualifies under our warranty terms. This process typically takes 5-7 business days.
- Claim Resolution: If your claim is approved, we'll contact you to discuss the next steps. Based on our assessment, we'll arrange for the repair of your mattress. Please note, in cases where materials can't be repaired, we may proceed with replacing only the affected materials, as per our warranty terms.
- Pick-up and Delivery for Repair: If this is your first claim, we'll arrange to pick up your mattress and deliver it back to you after the repair, at no cost to you (as detailed in Section 5 - Shipping and Delivery).
- Final Decision: The decision made by SleepTailor's experts will be final and binding. We strive to resolve your claim as quickly and efficiently as possible to ensure your satisfaction.
SECTION 7 - RETURN & EXCHANGE POLICY
At SleepTailor, we pride ourselves on delivering the highest quality, custom-designed mattresses tailored specifically to your needs. To ensure complete satisfaction with your purchase, please take a moment to review our order policy.
1. Order Confirmation & Cancellation Policy: Once your order has been placed and payment has been confirmed, the mattress design and production process begins immediately. As our mattresses are bespoke and tailored to your specific preferences, we're unable to accept cancellations once an order is confirmed. Please ensure that all details, including your mattress specifications and payment information, are accurate before confirming your order.
2. Return & Exchange Policy: Due to the customized nature of our bespoke mattresses:
- We don't offer exchanges for mattresses once they've been delivered and used.
- We don't accept returns once the order is placed and confirmed.
This ensures that we deliver a brand-new, personalized, and made-to-order product just for you.
3. Size Policy: As our mattresses are custom-made to your specifications, we're unable to accept returns or exchanges for size-related issues. It's the responsibility of the customer to provide the correct size dimensions at the time of the order. Please double-check the dimensions of your bed frame or space to ensure the mattress fits perfectly. If you need assistance determining the right size, our team is happy to guide you during the consultation process.
4. Policy for Damaged or Defective Mattresses Upon Delivery: If your mattress is defective upon delivery or arrives damaged, please contact us immediately via our WARRANTY CLAIM PAGE within the first 48 hours of receiving the mattress. We'll assess the issue and, if it qualifies under our warranty terms, we'll repair the mattress and re-deliver it to you. Important: Any faulty product intimation made after the first 48 hours will be considered a standard warranty claim, subject to the full terms outlined in Section 6 - Warranty Policy. The decision as to whether the mattress will be repaired or replaced (materials only) is at our discretion and will be final.
5. No Monetary Compensation or Full Replacement: As detailed in Section 6 - Warranty Policy, our warranty includes repair services only, and we don't offer monetary compensation or full replacement for general returns or changes in preference. If there's a valid warranty claim where repair isn't feasible, SleepTailor's maximum liability for compensation will be limited to 50% of the mattress value.
SECTION 8 - INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by SleepTailor, its affiliates or licensors and are protected by U.S. and foreign patent, copyright, and other intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. You mustn't reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of SleepTailor, Shopify, or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by SleepTailor. SleepTailor’s names, logos, product and service names, designs, and slogans are trademarks of SleepTailor or its affiliates or licensors. You mustn't use such trademarks without the prior written permission of SleepTailor. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
SECTION 9 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control or input over. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of the optional tools offered through the site is entirely at your own risk and discretion, and you should ensure that you're familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

SECTION 10 - THIRD-PARTY LINKS
The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third-party functionality). We're not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third-party sites, you do so at your own risk. We're not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.
SECTION 11 - RELATIONSHIP WITH SHOPIFY
SleepTailor is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with SleepTailor. By using the Services, you acknowledge and agree that Shopify isn't responsible for any aspect of any sales between you and SleepTailor, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with SleepTailor.
SECTION 12 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may be subject to Shopify’s Privacy Policy, which can be viewed. By using the Services, you acknowledge that you've read these privacy policies. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy for more details on how we, Shopify, and our partners use your personal information.

SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you've submitted your order).

You may access and use the Services for lawful purposes only. You can't access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that doesn't comply with these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any “junk mail,” “chain letter,” “spam,” or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm SleepTailor, Shopify, or users of the Services, or expose them to liability. In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, pretext, spider, crawl, or scrape; or (e) interfere with or circumvent the security features of the Services or any related website, other websites, or the Internet. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you've violated any part of these Terms.

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you'll remain liable for all amounts due up to and including the date of termination. The following sections will continue to apply following any termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

The information presented on or through the Services is made available solely for general information purposes. We don't warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents. EXCEPT AS EXPRESSLY STATED BY SleepTailor, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS LIMIT OR DON'T ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.
SECTION 18 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL SleepTailor, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 19 - INDEMNIFICATION
You agree to indemnify, defend, and hold harmless SleepTailor, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services. We'll notify you of any indemnifiable claim, provided that a failure to promptly notify won't relieve you of your obligations unless you're materially prejudiced.
